{"id":563,"date":"2007-11-20T15:03:32","date_gmt":"2007-11-20T19:03:32","guid":{"rendered":"https:\/\/blacknell.net\/dynamic\/2007\/11\/20\/gun-control-back-in-the-spotlight\/"},"modified":"2007-11-20T15:03:32","modified_gmt":"2007-11-20T19:03:32","slug":"gun-control-back-in-the-spotlight","status":"publish","type":"post","link":"https:\/\/blacknell.net\/dynamic\/2007\/11\/20\/gun-control-back-in-the-spotlight\/","title":{"rendered":"Gun Control: Back in the Spotlight"},"content":{"rendered":"<p>Every Democrat in the country better be ready for a barrage of gun control questions between now and the general election next year.\u00c2\u00a0 Why?\u00c2\u00a0 The Supreme Court <a href=\"http:\/\/www.nytimes.com\/2007\/11\/20\/washington\/20cnd-scotus.html?_r=1&amp;hp&amp;oref=slogin\">has agreed to hear<\/a> a case that goes to the core of the Second Amendment, which reads:<\/p>\n<blockquote><p>A well-regulated Militia being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.<\/p><\/blockquote>\n<p>Vastly oversimplifying things, it&#8217;s about whether the &#8220;right to bear arms&#8221; is a right that you &#8211; as an individual &#8211; have, or whether the right to bear arms is only as part of a &#8220;well-regulated Militia&#8221; (which is then up to the States to define).\u00c2\u00a0 If there is an *individual* right to bear arms, then many of the existing restrictions on gun acquisition and ownership may well be found unconstitutional.\u00c2\u00a0 I think it&#8217;s a perfectly valid question, and something that the Supreme Court has been avoiding for years.\u00c2\u00a0 So I&#8217;m happy to see that it will be sorted out.\u00c2\u00a0 As a lawyer, anyway.<\/p>\n<p>But the real harm here is going to be the reinsertion of the &#8220;Democrats want to take your guns away!&#8221; canard into the political sphere.\u00c2\u00a0 If ever it was true, it certainly hasn&#8217;t been true for decades.\u00c2\u00a0 Yet it remained a regular (and effective) rallying cry for the GOP (a wholly owned subsidiary of the NRA, for the purpose of this issue).\u00c2\u00a0 It had faded, in recent years, and I was glad to see that.\u00c2\u00a0 But look for this case to put it front and center again.\u00c2\u00a0 Democrats need to prepare to ready, aim, and fire back.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Every Democrat in the country better be ready for a barrage of gun control questions between now and the general election next year.\u00c2\u00a0 Why?\u00c2\u00a0 The Supreme Court has agreed to hear a case that goes to the core of the Second Amendment, which reads: A well-regulated Militia being necessary to the security of a free [&hellip;]<\/p>\n","protected":false},"author":2,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_exactmetrics_skip_tracking":false,"_exactmetrics_sitenote_active":false,"_exactmetrics_sitenote_note":"","_exactmetrics_sitenote_category":0,"ngg_post_thumbnail":0,"activitypub_content_warning":"","activitypub_content_visibility":"","activitypub_max_image_attachments":4,"activitypub_interaction_policy_quote":"anyone","activitypub_status":"","footnotes":""},"categories":[9,4,6],"tags":[],"class_list":["post-563","post","type-post","status-publish","format-standard","hentry","category-dc","category-law","category-policy"],"aioseo_notices":[],"_links":{"self":[{"href":"https:\/\/blacknell.net\/dynamic\/wp-json\/wp\/v2\/posts\/563","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/blacknell.net\/dynamic\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/blacknell.net\/dynamic\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/blacknell.net\/dynamic\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/blacknell.net\/dynamic\/wp-json\/wp\/v2\/comments?post=563"}],"version-history":[{"count":0,"href":"https:\/\/blacknell.net\/dynamic\/wp-json\/wp\/v2\/posts\/563\/revisions"}],"wp:attachment":[{"href":"https:\/\/blacknell.net\/dynamic\/wp-json\/wp\/v2\/media?parent=563"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/blacknell.net\/dynamic\/wp-json\/wp\/v2\/categories?post=563"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/blacknell.net\/dynamic\/wp-json\/wp\/v2\/tags?post=563"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
